1. Use of the Service

• You may use Whisprice without age restrictions; however, by using the Service, you confirm that you have the legal capacity to enter into a binding agreement or have obtained permission from a parent or legal guardian if required by your local laws.

• You agree to use the Service only for personal, non-commercial purposes unless otherwise authorized.

• The Early Bird subscription is intended solely for personal use. You may not use the extended price history data for commercial analytics, resale, or business intelligence purposes.

• You are responsible for maintaining the security of your account and any activity associated with it.

2. Description of Service

Whisprice is a personalized price tracking tool. It allows you to monitor the prices of specific products via user-defined URLs, receive subtle alerts for meaningful price changes, and view historical price insights, all in a non-intrusive way.

We do not sell products, display third-party advertisements, or offer generic deals.

3. Account Registration

To use Whisprice, you must create an account. Registration is required to access all features, including price tracking, notifications, and historical insights.

You can sign up or log in securely using your Apple or Google account. By registering, you agree to provide accurate and current information and to keep your login credentials safe. You are responsible for all activity that occurs under your account.

4. Paid Subscriptions (The Early Bird Plan)

While Whisprice offers a robust free version, you may choose to upgrade to our Early Bird plan to unlock enhanced features, such as increased tracking capacity and extended price history.

4.1. Subscription Plans 

We offer different subscription tiers to suit your needs, including a flexible monthly plan and a longer-term value pass (e.g., 6 months). The specific features, limits, and pricing for each tier are displayed clearly within the App before you confirm your purchase.

Subscription pricing may vary by country and is displayed in your local currency on the Apple App Store or Google Play Store at the time of purchase.

4.2. Billing and Payments 

Payment for your subscription will be charged to your Apple ID or Google Play account at confirmation of purchase. All billing is handled directly by the respective app store; Whisprice does not store your credit card or payment information.

4.3. Automatic Renewal 

To ensure your price tracking is never interrupted, your subscription automatically renews unless you turn off auto-renew at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current price.

4.4. Cancellation 

You are in control. You can manage or cancel your subscription at any time through your Account Settings on the Apple App Store or Google Play. If you cancel, you will continue to have access to the Early Bird features until the end of your current billing period.

Upon cancellation or expiry of your paid subscription, your account will revert to the Free Plan. Rather than deleting your tracked products, Whisprice will deactivate price tracking for products that exceed the Free Plan limit, preserving your data. Your 5 most recently added products will remain actively tracked. You may reactivate tracking for any deactivated products at any time, subject to your current plan limits.

The same applies in the event of a payment failure: your account will transition to the Free Plan and tracking will be deactivated (not deleted) for products beyond the Free Plan limit, starting with the oldest-added items.

4.5. Refunds 

Since payments are processed by third-party app stores (Apple and Google), Whisprice does not have the ability to issue refunds directly. Refund requests must be made directly to Apple or Google in accordance with their respective refund policies.

4.6. Price Changes 

Subscription prices may vary by country and are set in accordance with local App Store and Google Play pricing tiers. We may occasionally adjust our subscription pricing. If we do, we will notify you in advance. Continued use of the paid service after a price change constitutes your agreement to the new price.

5. Plan Limits and Usage

A summary of your current plan limits is available at any time within the App under Profile > Your Usage.

Plan limits include the following:

• Total Tracked Products: The maximum number of products you can have actively tracked at any one time

• Monthly Products Added: The maximum number of new products you can add within a calendar month

• Price Check Frequency: How often Whisprice checks for price updates. Free plan users receive checks approximately every 24 hours; Early Bird users receive checks approximately every 12 hours.

• Price History: Free plan users can view price history for the last 30 days. Early Bird users have access to the full price history from the date the product was added.

Price history begins accumulating from the date a product is first added. If a user upgrades to the Early Bird plan, any historical data older than 30 days that was collected during the paid period will remain accessible.

We reserve the right to adjust existing limits or introduce new ones at any time to maintain service quality and prevent abuse.

6. Product Tracking and URL Validity

6.1. Valid Product URLs

Whisprice is designed to track individual product pages. When you add a URL, we verify that it points to a valid, trackable product page. URLs pointing to listing pages, category pages, search results, or unrelated websites will be rejected at the time of submission.

6.2. Unreachable or Removed Product Pages

If a product page you are tracking becomes unavailable (for example, because the retailer removed or changed the listing), Whisprice will flag the item as unreachable within the App. We recommend removing such products to keep your tracking list accurate. We are not responsible for changes made by third-party retailers to their product pages.

6.3. Inactive Tracking

If a product is no longer tracked by any user, Whisprice may discontinue active price monitoring for that product. Price history already collected for that product during the period it was tracked will be retained in accordance with our data policies.

6.4. Inactivity Suspension

If your account shows no login activity for 30 consecutive days, Whisprice reserves the right to temporarily suspend active price tracking for your products. Your products and their price history will not be deleted. You may reactivate tracking at any time by logging back into the App, subject to your current plan limits.

7. Intellectual Property

The Whisprice brand, interface, and technology are the property of their respective owners and protected by applicable intellectual property laws.

You may not copy, reproduce, reverse-engineer, or use any part of the App's content, design, or functionality without prior written permission.

8. User Conduct

To ensure a fair and reliable experience for all users, you agree not to:

• Use bots, scripts, or other automated methods to misuse or overload the Service.

• Interfere with our servers or crawl the App or website in ways not intended by the platform.

• Track or monitor URLs that you do not have the legal right to access.

• Submit URLs pointing to content that is pornographic, illegal, harmful, or otherwise objectionable, as determined at Whisprice's sole discretion.

• Submit URLs or use the Service for the purpose of benchmarking, competitive analysis, or reverse engineering of Whisprice's features, pricing behavior, or tracking methodology.

• Create or use additional accounts to circumvent a restriction, suspension, or ban applied to another account.

• Circumvent or attempt to bypass usage limits, including the maximum number of products you can add per month or in total.

9. Third-Party Content and Affiliate Links

Whisprice monitors third-party product pages (URLs) at your request. We are not responsible for the content, pricing policies, or availability of any third-party retailer or website.

9.1. Affiliate Links

Whisprice may convert product URLs you submit into affiliate links. When you visit a retailer through such a link, Whisprice may earn a commission. This conversion does not affect the price you pay, and is disclosed on each product detail page within the App.

Whisprice may also suggest affiliate brands within the App. These suggestions will be clearly labelled as such when the feature is active.

Affiliate activity is processed on the basis of our legitimate interests in operating and financially sustaining the Service. It does not involve sharing your personal data with retailers or advertisers.

9.2. Price Accuracy and Limitations

We make every effort to track prices accurately, but please be aware of the following limitations:

• Currency: We make our best effort to track prices in the currency corresponding to your region or the retailer's local storefront. In some cases, a price may be tracked in a different currency.

• Loyalty and Member Discounts: We can only track publicly displayed prices. Prices that require membership, loyalty programme enrollment, or a logged-in account at the retailer may not be reflected in our tracking.

• Login-Restricted Prices: If a retailer requires users to log in before a price is visible, Whisprice is unable to track that price.

• Notification Timing: Price change notifications may be delivered with a short delay after a price change is detected, to ensure accuracy before alerting you.

We do not guarantee the accuracy, completeness, or legality of any third-party pricing data.

10. Notifications

Our goal is to notify you only when it matters. By using Whisprice, you consent to receive push or in-app notifications related to your tracked items.

You may disable notifications at any time in your device or app settings.

11. Data Retention and Deletion

• If you delete a product from your tracking list, your personal association with that product is removed. Aggregated or anonymized price history for that product may be retained for service quality purposes.

• If you delete your account, all personal data and product relationships associated with your account will be removed in accordance with our Privacy Policy.

• Price history is stored from the date a product is first added by any user. Once no user is actively tracking a product and it has been removed by all, we may discontinue collecting and storing new price data for it.

12. Changes and Updates

We may modify or discontinue the Service (or parts of it) at any time.

We may also update these Terms, and if we do, we will notify you through the App or our website. Continued use means you accept the updated Terms.

13. Termination

We reserve the right to suspend or terminate your access if you violate these Terms or misuse the Service. You may also delete your account at any time.

If your paid subscription ends or is terminated, your account will revert to the Free Plan. Price tracking will be deactivated (not deleted) for products exceeding the Free Plan limit, with the exception of your 5 most recently added products, which will remain actively tracked.

14. Disclaimer of Warranty

The Service is provided "as is." We make no warranties regarding accuracy, availability, or fitness for a particular purpose. Price data may occasionally be delayed or inaccurate due to third-party changes beyond our control.

15. Limitation of Liability

To the fullest extent permitted by law, Whisprice and its creators are not liable for any damages arising from your use of the Service, including lost savings, missed discounts, or errors in price tracking.

16. Privacy

Your privacy matters. Our Privacy Policy explains what data we collect and how it is used. 

By using Whisprice, you agree to the practices described there.

17. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of laws principles.

Any disputes arising from or related to the Service will be subject to the exclusive jurisdiction of the courts of Amsterdam, unless otherwise required by applicable law.
